Please read these Terms and Conditions (“Terms”) carefully before using the websites operated by HostNet Club, including https://hostnetclub.com, https://panel.hostnetclub.com, and all associated subdomains (collectively, the “Site”).

By accessing or using our Site or any of our products or services (collectively, the “Services”), you agree to be bound by these Terms. If you do not agree with any part of the Terms, you must not use our Services.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age;
  • Have the legal capacity to enter into a binding agreement;
  • Not be barred from using our Services under any applicable laws;
  • Provide accurate and complete registration information.

We reserve the right to verify your identity and eligibility at any time.

3. Account Registration and Security

By creating an account, you agree to:

  • Provide truthful, accurate, and up-to-date information;
  • Maintain the confidentiality of your login credentials;
  • Notify us immediately of any unauthorized access to your account.

You are fully responsible for all activities conducted through your account.

4. Acceptable Use Policy (AUP)

You may only use our Services for lawful purposes. The following actions are strictly prohibited:

  • Distributing or linking to malware, viruses, or malicious software;
  • Hosting, distributing, or linking to illegal content (e.g., pirated media, hacking tools);
  • Hosting content related to pornography, racism, hate speech, or violence;
  • Using services to conduct phishing, fraud, or bulk emailing/spamming;
  • Running resource-intensive scripts or software that degrades server performance;
  • Engaging in hacking, DDoS, brute force attacks, or illegal proxy usage.

Violation of the AUP may result in immediate suspension or termination without refund.

5. Domain Registration and Hosting

a. Domain Registration

All domain registrations are governed by the rules of the relevant registry (e.g., ICANN or NIXI). You must provide accurate WHOIS details and complete KYC verification as required. We reserve the right to suspend domains with false or unverifiable information.

b. Hosting Services

You may use our shared, VPS, cloud, or dedicated hosting as per your subscription plan. Misuse of hosting resources (e.g., exceeding CPU/RAM limits, sending spam, or illegal file hosting) may result in account suspension.

We do not allow the following types of content or services:

  • Adult or pornographic material;
  • Warez, file dumps, mirror/ad services;
  • Auto-surf, HYIP, or pyramid schemes;
  • Online pharmacies or sale of controlled substances.

6. Uptime Guarantee

We strive to maintain 99.9% uptime across all services. In the event of unplanned downtime exceeding this, customers may request a prorated credit of hosting fees.

7. Payment, Billing, and Refunds

All prices are listed in INR unless otherwise stated.

  • Payments can be made via authorized gateways (e.g., Razorpay, Paytm, Stripe);
  • Services are billed on a recurring basis unless canceled;
  • It is your responsibility to ensure timely payments and updated billing info.

Refunds

Refunds are provided only under the following conditions:

  • Within 7 days of purchase for shared/managed hosting (first-time orders only);
  • No refunds for VPS, dedicated servers, or custom plans;
  • No refunds for domain registration or policy-violating terminations;
  • Licenses and third-party tools are non-refundable.

We are not liable for overdraft fees due to continued payments after cancellation unless caused by our system error.

8. Backups and Data Policy

We offer backup services (limited to managed plans). Backups are retained for 14 days, but we do not guarantee restoration. Users are advised to maintain their own offsite backups. Custom backup setups are available upon request.

9. Spam and Mailing Policy

Unsolicited bulk email (spam) is prohibited. Each account is allowed up to 350 messages per hour. Mailing lists must be confirmed opt-in only. Violations may incur blacklist removal fees (₹20,000+). Repeat violations may lead to termination without refund.

10. Data Migration Support

We provide free migration assistance to new shared or managed hosting clients. You must submit a support request with access details of your previous host.

11. Suspension and Cancellation

We reserve the right to suspend or cancel your services for:

  • Violating our Terms, AUP, or legal regulations;
  • Failure to complete KYC;
  • Non-payment.

You may cancel services at any time via your dashboard. Refunds may be issued based on our refund policy. Recurrent payments made in error after cancellation will not make us liable for any bank or processing charges.

12. Content Restrictions

We do not allow:

  • Hosting or linking to adult/pornographic content;
  • Racist or discriminatory content based on religion, caste, or belief systems.

Detection of such content may result in account termination without prior notice.

13. Intellectual Property

All content, branding, and services provided by HostNet Club are protected under copyright and trademark laws. Unauthorized duplication, modification, or use is strictly prohibited.

14. Disclaimer and Limitation of Liability

Our Services are provided “as-is” and “as available.”

  • We make no warranties regarding uninterrupted or error-free access;
  • We are not liable for any damages from policy violations or misuse;
  • In no event shall our liability exceed fees paid by the user in the prior 12 months.

15. Indemnification

You agree to indemnify and hold harmless HostNet Club and its team from any legal claims, damages, or liabilities arising from your use of our Services or violation of these Terms or any applicable law.

16. Force Majeure

We are not responsible for service failures caused by events beyond our control including but not limited to natural disasters, wars, terrorism, pandemics, power outages, or third-party provider issues.

17. Governing Law

These Terms are governed by the laws of India. All disputes shall be exclusively subject to the courts of Gurugram, Haryana.

18. Changes to Terms

We may modify these Terms at any time. Updates will be published with the new “Last Updated” date. Continued use of Services implies your acceptance of the revised Terms.
